Our mission is to provide you with a perfect sound experience, not to collect your personal data. However, the comfort functions of your device imply that we process some personal data. We provide information on this here. Only in very exceptional cases will we store personal data, especially if you make a service request. Normally, we only store anonymous statistical data. In detail:

1. What Data We Process

a) Normal Use

You can use your device without us knowing anything about you or your use of your device. Simply do not connect to the Internet with your device.

b) Comfort Functions

If you want to use the comfort functions of your device, such as the musicDB, the download of cover images or firmware updates, your device must contact us via the Internet. For technical reasons, we will always learn your IP address and thus, for example, your approximate location. However, we do not store your IP address. Exception: Your device is reported stolen. The serial number of your device will be sent to us every time your device contacts our servers but will only be stored if your device is reported stolen. In such event, we reserve the right to disclose to the owner the IP address, serial number and any other information that may be extracted from the device and used for retrieval or prosecution purposes. Furthermore, law enforcement authorities may request such data. The data will be deleted as soon as they are no longer needed for the purpose of retrieval of your device.

We only store technical data without linking to the IP address and serial number, e.g. data on technical details and use such as the number of ripped CDs or whether you use Online Services. These data are merely statistical and have no relation to persons.

c) Service Request

When you send us a service request, we process on the one hand the data you provide and on the other hand, if you tick the respective checkbox, certain information about the status of your device. Furthermore, we may add data on how we handle your request. This data will only be used to process your request and will be deleted at the latest three months after our last message to you. If you have any further questions, please contact us again within three months.

d) Recipients Or Categories Of Recipients

Personal data will not be disclosed to third parties, except for the owner and possibly law enforcement agencies in case of devices reported stolen. Data submitted with a service request will be disclosed to our service personnel. The servers we use for the provision of our services are hosted in Germany. The safety precautions taken meet the highest standards and are updated regularly. At no time do external persons and persons without the required permission have access to customers personal data.

e) Data Exports

In general, the few personal data we process are processed in Germany. However, the owner of a stolen device might live in a country we do not know at present and the level of data protection in such country therefore presently cannot be communicated.

f) Retention Period

In normal operation, no personal data will be stored. In case of a device reported stolen, the data will be deleted as soon as they are no longer needed for the purpose of retrieval of your device. In case of a service request, the data will be deleted at the latest three months after our last message to you.

g) Voluntary Nature Of Provision Of Personal Data

You may use your device without providing personal data but some personal data is necessary for using the comfort functions. When you send a service request, you do not need to tick the checkbox for sending technical details and may also do so using any communication channel which does not involve automatic provision of technical data, and you are not obliged to provide any personal data at all – it’s just that we might not be able to solve your problem if we do not have sufficient data.

h) Your Rights

You may

  • request from us access to and rectification or erasure of your personal data or restriction of processing and you may object to processing and have a right to data portability;
  • withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal; furthermore, we also might base further processing on another legal basis;

Furthermore, Burmester avails itself of appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss and destruction and against access by unauthorised third parties. These security measures are continuously improved in accordance with technological development.
